A board of waterworks and sewerage commissioners as required and authorized by Tennessee Code Annotated, 7-35-407--7-35-409, to have supervision and control of the construction and operation of the waterworks and sewerage systems of the Town of Sevierville. The board of waterworks and sewerage commissioners shall have such powers and duties and shall be subject to such limitations as are prescribed in Tennessee Code Annotated 7-35-407--7-35-432 (1977 Code 13-101)

Recreation Committee

SECTION
2-101.  Creation of committee.
2-102.  Composition; appointment of members; terms and eligibility for office.
2-103.  Powers and duties.

2-101.  Creation of committee. There is hereby created a recreation committee which shall exist during the pleasure of the board of mayor and aldermen and shall act in accordance with the rules and regulations prescribed in this chapter. (Ord. #483, July 1985, as amended by Ord. #529, Mar. 1987, and Ord. #095-02, April 1995)

2-102.  Composition; appointment of members; terms and eligibility for office. The parks and recreation committee shall be comprised of seven (7) members elected by the board of mayor and aldermen by a majority vote upon nomination by the mayor. The membership of the committee shall include a minimum of four (4) city residents and only one (1) member shall at the same time be a member of the board of mayor and aldermen. At least two (2) members of the committee shall have an interest and understanding of a golf course and its operation.

The member appointed from the board shall serve a one (1) year term and shall be eligible to serve no more than two (2) consecutive full terms on the committee. Should such appointee's membership on the board expire, his term upon the committee shall also expire on the same date.

The remaining members of the committee shall serve four (4) year terms with the initial terms being staggered such that the appointments made to the committee shall expire on September 1, each year.

Appointments shall be made to the committee at the first regularly scheduled meeting of the board of mayor and aldermen following final passage of this chapter, at which time the board shall also set the time and place of the initial meeting of the committee. The basis for selection of members shall be as follows:

(1) Interest in recreational growth and recreational programs within the City of Sevierville and Sevier County;
(2) Availability of time to devote to the parks and recreation committee;
(3) Willingness to accept the responsibilities and duties in connection herewith; and
(4) Ability to perform the required duties.

Any member who is absent from three (3) consecutive meetings without the prior consent of the committee, may be removed from the committee by the board of mayor and aldermen upon the recommendation of the committee. Any vacancy on the committee otherwise than by expiration of term shall be filled only for the unexpired term. (Ord. #483, July 1985, as amended by Ord. #094-22, June 1994, and Ord. #095-02, April 1995)

2-103.  Powers and duties. The committee shall act in an advisory capacity only and shall have no authority to bind the board of mayor and aldermen, mayor, or City of Sevierville in any way except as the board of mayor and aldermen may from time to time direct. The committee shall make recommendations to the board of mayor and aldermen on matters relating to recreation when requested by the board. In addition, the committee may, from time to time, offer recommendation to the board concerning regulation, operation, and maintenance of the city's recreation programs and facilities. 2-201.  Definitions. (1) "Street trees" are herein defined as trees, shrubs, bushes, and all other woody vegetation on land lying between property lines on either side of all streets, avenues, or ways within the city.

(2) "Park trees" are herein defined as trees, shrubs, bushes, and all other woody vegetation in public parks having individual names, and all areas owned by the city, or to which the public has free access as a park, such as a bike, jogging, or walking trail, or small street or civic garden. (Ord. #466, May 1984)

2-202.  Creation and establishment of a city tree board. There is hereby created and established a city tree board for the City of Sevierville, Tennessee, which shall consist of an eight member board. Tree board members shall be citizens and residents of the city or county with one member being a representative from the Tennessee Department of Conservation, Division of Forestry, and one member being the director of parks and recreation who shall be a voting member in case of a tie vote only, and shall serve as chairman of the tree board. All appointed members shall be appointed by the mayor and approved by the board of aldermen. (Ord. #466, May 1984, as amended by Ord. #645, June 1991)

2-203.  Term of office. The terms of three persons appointed to the tree board shall be for two (2) years, or for three members a three (3) year term. The board of aldermen representative term shall be an annual appointment by the mayor and approved by the board of aldermen. The chairman shall be the director of parks and recreation and shall serve during the status of employment with the City of Sevierville. In the event that a vacancy shall occur during the term of any member, his/her successor shall be appointed for the expired portion of the term. (Ord. #466, May 1984, as amended by Ord. #645, June 1991)

2-204.  Compensation. Members of the board or related committees shall serve without compensation. (Ord. #466, May 1984)

2-205.  Duties and responsibilities. It shall be the responsibility of the board to study, investigate, counsel and develop and/or update annually, and administer a written plan for the care, preservation, pruning, planting, replanting, removal or disposition of trees and shrubs in parks, along streets, bike trails, and in other public areas. Such plan will be presented annually to the board of mayor and aldermen and upon their acceptance and approval shall constitute the official comprehensive city tree plan for the City of Sevierville, Tennessee. The board, when requested by the board of mayor and aldermen, shall consider, investigate, make findings, report and recommend upon any special matter of question coming within the scope of its work. (Ord. #466, May 1984)

2-206.  Operation. The board shall elect all officers except the chairman, make its own rules and regulations and keep a journal of its proceedings. A majority of the members shall be a quorum for the transaction of business. The director of parks and recreation shall serve as chairman of the tree board, providing staff support as is required for the board to carry out its duties. (Ord. #466, May 1984, as amended by Ord. #645, June 1991)

2-207.  Street tree species to be planted. The following list constitutes the official street tree species for Sevierville, Tennessee. No species other than those included in this list may be planted as street trees without written permission of the city tree board. SMALL: Apricot, Flowering crabapple, Flowering weeping cherry, Golden rain tree (Hawthorne), Bradford pear, Redbud, Dogwood, Lilac, Flowering peach, Plum. MEDIUM: Green ash, Honeylocust (thornless), Linden, Mulberry (fruitless, male), English and red oak, Pagodatree, Pecan, Persimmon, White poplar. LARGE: Silver maple, Sugar maple, Bur Oak, Sycamore, White Pine. (Ord. #466, May 1984)

2-208.  Spacing. The spacing of street trees will be in accordance with the three species size classes listed in section 2-207 of this chapter, and no trees may be planted closer together than the following:

(1) Small trees, 20 feet;
(2) Medium trees, 30 feet; and
(3) Large trees, 40 feet;
(4) except in special planting designed or approved by the city engineer or landscape architect. (Ord. #466, May 1984)

2-209.  Distance from curbs and sidewalks. The distance trees may be planted from curbs or curblines and sidewalks will be in accordance with the three species size classes listed in section 2-207 of this chapter, and no trees may be planted closer to any curb or sidewalk than the following:

(1) Small trees, 2 feet;
(2) Medium trees, 2.5 feet;
(3) Large trees, 3 feet. (Ord. #466, May 1984)

2-210.  Distance from street corners and fireplugs. No street tree shall be planted closer than 30 feet of any street corner, measured from the point of nearest intersecting curbs or curblines. No street tree shall be planted closer than 8 feet of a fireplug. (Ord. #466, May 1984)

2-211.  Utilities. No street trees other than those species listed as small or medium trees in section 2-207 of this chapter may be planted under or within 10 lateral feet of any overhead utility wire, or over or within 5 lateral feet of any underground water line, sewer line, transmission line or other utility. (Ord. #466, May 1984)

2-212.  Public tree care. The city shall have the right to plant, prune, maintain and remove trees, plants and shrubs within the lines of all streets, alleys, avenues, lanes, squares and public ways to promote safety or to preserve or enhance the symmetry and beauty of such public grounds. The city tree board may remove or cause or order to be removed, any tree or part thereof, which is in an unsafe condition or which by reason of its nature is injurious to sewers, electric power lines, water-lines, or other public improvements, or is affected with any injurious fungus, insect or other pest. This section does not prohibit the planting of street trees by adjacent property owners providing that the selection and location of said trees is in accordance with sections 2-207 through 2-211 of this chapter. (Ord. #466, May 1984)

2-213.  Tree topping. It shall be unlawful as a normal practice for any person, firm, or city department to top any street tree, park tree, or other tree on public property. Topping is defined as the severe cutting back of limbs to stubs larger than three inches in diameter within the tree's crown to such a degree so as to remove the normal canopy and disfigure the tree. Trees severely damaged by storms or other causes, or certain trees under utility wires or other obstructions where other pruning practices are impractical may be exempted from this chapter at the determination of the city tree board. (Ord. #466, May 1984)

2-214.  Pruning, corner clearance. Every owner of any tree overhanging any street or right-of-way within the city shall prune the branches so that such branches shall not obstruct the light from any street lamp or obstruct the view of any street intersection and so that there shall be a clear space of fourteen (14) feet above the surface of the street or sidewalk. Said owners shall remove all dead, diseased, or dangerous trees, or broken or decayed limbs which constitute a menace to the safety of the public. The city shall have the right to prune any tree or shrub on private property when it interferes with the proper spread of light along the street from a street light or interferes with visibility of any traffic control device or sign. (Ord. #466, May 1984)

2-215.  Dead or diseased tree removal on private property. The city shall have the right to cause the removal of any dead or diseased trees on private property within the city, when such trees constitute a hazard to life and property, or harbor insects or disease which constitute a potential threat to other trees within the city. The city tree board will notify in writing the owners of such trees and charge the cost of removal on the owners property tax notice. (Ord. #466, May 1984)

2-216.  Removal of stumps. All stumps of street and park trees shall be removed below the surface of the ground so that the top of the stump shall not project above the surface of the ground. (Ord. #466, May 1984)

2-217. Interference with city tree board. It shall be unlawful for any person to prevent, delay or interfere with the city tree board, or any of its agents, while engaging in and about the planting, cultivating, mulching, pruning, spraying, or removing of any street trees, park trees, or trees on private grounds, as authorized in this chapter. (Ord. #466, May 1984)

2-218.  Arborists license and bond. It shall be unlawful for any person or firm to engage in the business or occupation of pruning, treating, or removing street or park trees within the city, without first applying for and procuring a license. The license fee shall be $25 annually in advance; provided, however, that no license shall be required of any public service company or city employee doing such work in the pursuit of their public service endeavors. Before any license shall be issued, each applicant shall first file evidence of possession of liability insurance in the minimum amounts of $50,000 for bodily injury and $100,000 property damage indemnifying the city or any person injured or damaged resulting from the pursuit of such endeavors as herein described. 2-219.  Review by board of mayor and aldermen. The board of mayor and aldermen shall have the right to review the conduct, acts, and decisions of the city tree board. Any person may appeal from any ruling or order of the city tree board to the board of mayor and aldermen who may hear the matter and make final decision. (Ord. #466, May 1984)

2-220.  Penalty. Any person violating any provision of this chapter shall be, upon conviction or a plea of guilty, subject to a fine not to exceed $50.00. (Ord. #466, May 1984)

The day-to-day management of The City of Sevierville is under the direction of the City Administrator. The City Administrator oversees management of all city departments and implements policy set by the Board of Mayor & Aldermen. The City Administer also directly oversees the human resource and risk management offices.

Recruitment And Employment Qualifications

The City of Sevierville considers applicants for all positions without regard to race, color, religion, creed, gender, national origin, age, disability, marital or veteran status, sexual orientation, or any other legally protected status. The City of Sevierville is an equal opportunity employer.

Applications for employment may be acquired at Sevierville City Hall.  Position applying for must be specified on the application and/or resume. If you are applying for more than one position, you must submit an application and/or resume for each specific job. Applications will be kept active for six months.

Every prospective employee, as part of the conditional offer of employment, shall undergo a criminal background check and a driving record background check, conducted by the City of Sevierville Police Department. Each person shall also be given a medical/physical examination by a licensed physician, which will include a drug/alcohol screening and a muscular-skeletal screening. Other examinations and screenings may be required depending upon the job for which you are applying. The cost of these examinations will be borne by the City.

No person, who is a close relative of an employee of the City of Sevierville or Board of Mayor and Alderman, shall be eligible for employment by the City of Sevierville. “Close Relative” means a person who is related to the to the principal person as a spouse, child, grandchild, parent, grandparent, brother, sister, aunt, uncle, nephew or niece by blood, brother-in-law, sister-in-law, “step” relatives and adoptive ones. This policy does not apply to seasonal or temporary employees, except that those employees may not directly supervise or be supervised by a close relative.

Insurance, Retirement, And Benefits

The City of Sevierville offers a benefits package to their full time employees. These benefits include paid medical and dental insurance, life insurance, short-term disability, and paid holidays. Upon hiring, city employees are automatically enrolled in the TN Consolidated Retirement System, which contributes 5% of an employee’s pre-tax dollars from each pay period into a retirement fund. Vacation leave is earned at a rate based on length of service. Sick leave is earned at 1 day per month.

Board of Mayor and Aldermen

The City of Sevierville is governed by a Board of Mayor & Aldermen in a home rule form of government. The Mayor is elected at-large for a two-year term and is a non-voting member of the Board of Aldermen. The Board of Aldermen consists of five members elected to four-year terms. The department was created in July of 1997 after the city severed golf course management ties with Arnold Palmer Management Co. Director of Golf Faye Randolph oversees the day-to-day operations of the 18-hole championship layout course that has become a favorite of locals and tourists alike.

The Finance Department is responsible for personal and business tax collection, licensing and permit payments, issuance of beer permits, City Court processes and other receivables.

Behind the scenes, the Finance Department is responsible for accounts payable, purchasing administration, human resources and personnel administration, budget development, risk management, maintaining City archives and overseeing all aspects of City finances.

Fire Department

The Sevierville Fire Department offers Class 4 fire protections to the city. The department has an authorized staff of 33 full time firemen. As part of the department’s long-range improvement plan, 24-hour service by paid staff was initiated during the summer of 1997.  The department provides response to fire, rescue, emergency medical, and hazardous materials incidents. The Sevierville Fire Department has a cooperative agreement with the Northview Fire Department to provide fire protection in that area of the city.

Information Services maintains operation of the city’s extensive computer network (including hardware and software applications) and provides information to the public through the official city web site, The Citizen newsletter, The Leisure Times Parks and Recreation newsletter, media releases,  special presentations, citizen surveys, and daily inquiries from citizens, groups and the media.  The department provides significant internal support to city departments and employees through development of special projects and presentations, development and maintenance of an employee intranet site and employee newsletter, and development and maintenance of custom databases.

The City of Sevierville has the distinction of having one of the best Parks & Recreation Departments in the State of Tennessee. Winners of numerous awards, the Parks & Recreation staff implements programs and services for youngsters to the elderly. The department manages the Sevierville Community Center, the Sevierville Civic Center and numerous city parks. The department has designed dozens of camps, clinics and programs to satisfy almost any recreational desire. The department is also in charge of the city’s Memorial River Trail Greenway program, the Urban Forestry/Tree City USA program, landscaping of city facilities and parks and other areas throughout the city, maintaining the city's Winterfest lights and providing general building maintenance for many city facilities.
